together.

These terms apply to all services provided by Kiilu (operated by Malin and Jimmy, Algarve, Portugal) including brand content creation and web development. By engaging our services, you agree to these terms. You can reach us at hello@kiilu.io.

Kiilu offers brand content creation (video and photo assets for use in paid advertising and organic social media) and web development (design and build of websites and focus sites). The specific deliverables, timelines and pricing for each project are agreed upon before work begins and confirmed in writing.

All prices shown on this website are starting points and subject to project scope. A final quote is provided after an initial consultation. Prices are in euro (€). Any amount shown in Swedish kronor (SEK) is approximate and for guidance only — the euro amount is the one that applies. VAT treatment is confirmed in your quote. Quoted prices are valid for 30 days from the date of issue.

Web development: Projects are invoiced in two stages: a 50% deposit before work begins, and the remaining 50% before the completed site is handed over. On larger projects we may agree a middle instalment, set out in your quote before work begins. Monthly care plans are billed at the start of each month. Brand content: Single-order packages are invoiced in full before content creation begins. Monthly retainers are billed at the start of each month. Late payments may result in work being paused or delivery being withheld. Outstanding balances unpaid after 14 days of the due date may incur a late payment fee. We reserve the right to suspend ongoing services until all outstanding invoices are settled.

Each package includes a set number of revision rounds as specified in your quote. Revisions are changes within the agreed scope — not new directions or additional features. Work beyond the included rounds is quoted separately.

Work is considered delivered when the completed project is shared with the client for review. If no written feedback is received within 7 days of delivery, the project is considered accepted as delivered. Any corrections identified after this period may be addressed at our discretion or quoted separately.

For web projects, Kiilu will address bugs or technical errors directly caused by our own work at no additional charge for 14 days following acceptance. This does not cover changes in scope, failures of third-party services, or issues arising from client modifications made after handover.

Upon receipt of full payment, the client receives full usage rights to all final delivered assets. Until full payment is received, all work remains the intellectual property of Kiilu and may not be published or used. Kiilu retains the right to display the work in its portfolio unless the client requests otherwise in writing before the project begins. Kiilu retains ownership of the underlying tools used to produce the work — components, templates, code structure, build setup, and the general methods and know-how developed before or during a project. These do not form part of the delivered assets and are not sold exclusively to any client. The client receives a perpetual, worldwide, non-exclusive right to use them as part of their own delivered project, and Kiilu continues to reuse and develop them across other projects. This does not limit the client's use of their own delivered project. Any third-party assets (stock assets, fonts, plugins) used in a project remain subject to their own respective licences.

The client is responsible for providing accurate content, brand assets and feedback within agreed timeframes. Delays caused by late feedback or missing assets may affect delivery timelines and are not the responsibility of Kiilu. The client warrants that any materials provided to Kiilu (logos, images, text) do not infringe on third-party rights.

If a client cancels a project after work has begun, the deposit is non-refundable. Any work completed up to the point of cancellation will be invoiced in proportion to the project fee set out in your quote, to the extent it exceeds the deposit already paid. If you are a consumer, the right of withdrawal below applies in addition to this.

If you are a consumer — a private individual acting outside a trade, business or profession — you have the right to withdraw from a service contract within 14 days of entering into it, without giving a reason, under Portuguese Decree-Law 24/2014. Because our work often begins quickly, we ask consumers to expressly request that we start during this 14-day period. If you do, you acknowledge that once the service is fully performed you lose the right of withdrawal. If you withdraw after work has begun but before it is finished, you are charged in proportion to the work already carried out. To withdraw, simply email us at hello@kiilu.io before the period ends. This section does not apply to business or professional clients.

Kiilu reserves the right to terminate a project if: the client fails to make payment within 14 days of a due date; the client fails to provide required materials or feedback within a reasonable timeframe, causing the project to stall; or the client's conduct becomes unreasonable. In such cases, all work completed to date will be invoiced and the deposit remains non-refundable.

Kiilu is not liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to illness, internet or infrastructure outages, natural events, or third-party service failures.

Projects may rely on third-party platforms such as Vercel (hosting), Sanity (CMS), Supabase (database), Shopify, or analytics tools. Kiilu is not responsible for changes, downtime, pricing adjustments, or discontinuation of any third-party service. After handover, the client is responsible for maintaining their own accounts and subscriptions with such services.

Kiilu's total liability for any claim arising from services provided is limited to the amount paid for the specific project in question. We are not liable for indirect, incidental or consequential losses.

These terms are governed by the laws of Portugal. Any disputes will be subject to the jurisdiction of the Portuguese courts. If you are a consumer, this does not deprive you of the protection of mandatory consumer laws of your country of residence.

These terms are published in English and Swedish. Prices are in euro (€); any Swedish kronor (SEK) amount shown is approximate and indicative only, and the euro amount stated in your quote is the one that applies. If there is any discrepancy between the language versions, or any question of interpretation, the English version prevails. If you are a consumer, this does not deprive you of any mandatory protection under the law of your country of residence.

If you are a consumer and we are unable to resolve a dispute directly, you have the right to refer it to an alternative dispute resolution (ADR) entity. The entity competent for our region is CIMAAL — Centro de Informação, Mediação e Arbitragem de Conflitos de Consumo do Algarve (www.consumoalgarve.pt). This information is provided under Portuguese Law 144/2015. A complaints book (Livro de Reclamações) is also available electronically at livroreclamacoes.pt. The authority responsible for the oversight of economic activity and consumer protection in Portugal is ASAE — Autoridade de Segurança Alimentar e Económica (asae.gov.pt).

We may update these terms from time to time. The current version always applies to new projects. Ongoing projects remain subject to the terms agreed at the time of engagement.
